Having bitten the bullet, though, you still don&#8217;t feel inclined to describe your contribution to the national effort in particularly generous or charitable terms. You would never guess it but you have a corner of sympathy with the economists and the government accountants of the country. They point to the tax laws of the country that often reward people with tax breaks for no reason, and make that up by taxing you, the taxpayer, a lot more than they would otherwise have to.</p>
<p>Let&#8217;s say that 30 years ago, you saw a bunch of computer makers with a dozen different computer designs, the Atari, the Commodore, the Apple, and you bet that that last one would probably make it big. You bought in on the ground floor, and today you find that your shares have appreciated ten times. If you sell them today, you&#8217;ll make a killing, and so will the IRS, because you&#8217;ll pay capital gains taxes. But let&#8217;s say that you don&#8217;t sell them today and you leave it to your heirs. Whoever inherits your Apple investment is going to cash in for free; financial advisors even recommend that if you&#8217;re pushing it a bit, that you don&#8217;t sell anything now and just write it off on your will. This really makes no sense if you think about it; a person who is 90 today and wishes to sell his stock portfolio will be hit by the tax laws as far as possible. If he had not sold anything, and he died the following day, his grandson who inherits it could sell it the very same day and he would not pay a dime in taxes. Over the next five years, the government will lose in a third of a trillion to this tax exemption.</p>
<p>It&#8217;s about the same way with the energy policy in the country. The government always has various incentives and high taxes to try to encourage or discourage one or the other kind of energy consumption behavior;  people get so mixed up over these pretty soon, they give up on trying to understand anything, and do what they would have anyway. Or like some unscrupulous manufacturers, they try to game the system. Five years ago, President Bush signed in a new energy policy that really went for ethanol; and the tax laws were amended to hand out lots of credits and tax breaks to any farmer or manufacturer who helped with the ethanol effort. Ethanol has been a nonstarter, though; it&#8217;s been using up so much corn that food prices have shot up, and the production of ethanol uses up so much gas and puts out so much pollution, that it hasn&#8217;t been worth it. And still, tax laws have handed manufacturers of ethanol about $12 billion of tax credits in the past four years alone.</p>
<p>You&#8217;ve been hearing about those Cadillac health plans for a while and the whole lead-up to the new health care plan, haven&#8217;t you? Consider one of the best perks you get at working a regular job &#8211; health insurance. Employer-provided health insurance, though, is tax exempted. In the beginning, that tax exemption didn&#8217;t really cost the government much, as healthcare was cheap. Healthcare now, though, is rising in cost in such a fearsome way that in about 100 years, it will be using up almost all our national income. Granting a tax exemption on this costs the government $1 trillion right now every five years. So what do employers do, but keep wages frozen, and choose to compensate workers with very pricey health insurance plans. If they compensated workers with regular salary increases, they would pay payroll taxes on them. And part-time workers who don&#8217;t have insurance anyway, just suffer in both ways &#8211; no salary increases, no free insurance either, and the need to pay a tax when they go out and buy their own personal health insurance.</p>
<p>When employers are so willing to buy the pricey health insurance schemes, insurance companies have no incentive to lower their prices either. There are a bunch of tax laws that work like this &#8211; punishing the poor and rewarding the rich. For instance, the mortgage interest deduction plan will give you a better break if you have a really large house. Sometimes the tax laws get so complicated, even the drafters of those laws get mixed up like this.</p>

			<content:encoded><![CDATA[<p>So, here is President Obama, with sweeping new plans for the nation&#8217;s education system; and item number one on the list? President Bush&#8217;s <strong>No Child Left Behind act</strong>, of course. The new plans seem to have their heart in the right place, and Congress is going to be debating huge changes to the education law. The No Child Left Behind act right now, requires every one of the nearly hundred thousand public schools around the year to be making yearly progress in test scores. If there are students who don&#8217;t get those minimum test scores, the schools must give them additional classes, or offer them a chance to transfer to another school. If the school is  regularly unable to do much for a student, the teachers responsible will be dismissed, and that school will be closed. The government never gave them much time to do all this either &#8211; everyone has heard of the 2014 deadline by which every child in America must be literate to a certain minimum degree.</p>
<p>The 2014 deadline has been especially hated. President Bush&#8217;s new rules went and gave so many schools an F, but never gave anyone a chance to improve, or gave them the means to do that. President Obama is getting rid of the 2014 deadline for starters; and then they will be looking at how they finance all the schools. It used to be that any district would get an amount of money from the budget depending on how many students they had in that district. Now, they&#8217;re going to be giving money to the 14,000 school districts around the country, depending on how well they do, how much improvement they can show in their students test scores.</p>
<p>But perhaps measuring everything by a test score is itself a big problem. The way children are taught and tested in schools today, has nothing at all to do with what our common sense tells us is right, and what the scientists tell us is the way to teach children. That the No Child Left Behind act is being reconsidered now is the best opportunity we have of trying to get it right all over again. Everyone knows, for example, that if you are asked to sit down and write an essay (or a report, if you work for a company), you&#8217;re just going to balk at the idea. Your report or essay ends up looking stiff, and filled with facts to put out an impression of a real message. You just need to be able to care about what you&#8217;re writing. If children could be asked to write about things that they actually cared about, not just one or two topics headed out to the whole class, and if they did it just to feel good, not degraded, things would go so much better.</p>
<p>One of the most basic things that the scientists tell us is, that children don&#8217;t learn to write by being forced to repeat the alphabet over and over again. All you need to do is to talk to the children and help them turn ideas over in their minds and describe things. This is what, they say, helps children build and hold ideas in their heads. Once they are able to do this, they will actually feel the need to write to communicate, and they will be able to understand the whole concept of writing too. Just asking them to write and repeat the alphabet until their heads go numb, is no way to do things. This is the kind of thing that the No Child Left Behind act is in a great position to reconsider. But if only they would.</p>

			<content:encoded><![CDATA[<p>The 4th amendment of the United States Constitution is part of the Bill of Rights, the bill of the first ten amendments to the Constitution. The 4th amendment itself guards against &#8220;unreasonable search and seizure,&#8221; as well as requiring arrest warrants that are supported by judicially confirmed probable cause. In many ways, it&#8217;s the 4th amendment upon which groups like American Civil Liberties Union, which most consider to be left-leaning, build their causes. Yet while the 4th amendment is the legal foundation for the ACLU, it&#8217;s right-leaning demagogues and voters who most often cite the 4th amendment as one to be held dear.</p>
<p>It&#8217;s a bizarre juxtaposition, one that&#8217;s wrapped up in what&#8217;s called &#8220;identity politics.&#8221; People who identify themselves as part off the &#8220;main group&#8221; &#8211; in the United States, that traditionally means white and middle class &#8211; tend to exhibit a fear of groups who identify as &#8220;other.&#8221; Traditionally that&#8217;s meant immigrant groups, blacks, American Indians, even women. Once one of these groups organizes and creates and identity, they become a threat to the status quo. What usually then ensues is a good old fashioned &#8220;identity politics&#8221; fight, in which the &#8220;other&#8221; group fights for equality in one way or the other.</p>
<p>So in the eyes of many Americans, the 4th amendment empowers &#8220;other&#8221; groups and becomes a thorn in the side of movements like the Know Nothings of the nineteenth century, or even this current century&#8217;s Tea Party movement. For people like the tea partiers, they claim that the Constitution and the Bill of Rights are sacred, but they want to eviscerate any rights (like the 4th amendment) that protect people of all races, ethnicities, religions and backgrounds.</p>
<p>This really began to become an issue in the 1960s, with the coming of desegregation, the Civil Rights Act of 1965 and the general integration of black Americans into the middle class.</p>
<p>One of the keystone rulings was 1967&#8242;s Katz vs. United States, in which Charles Katz had been convicted of illegal gambling through use of a local public payphone. Unbeknownst to Katz, the FBI had tapped the phone and used the tapes in the hearing. When the case made it all the way up to the supreme court, the court ruled that the 4th amendment protects people, not places. &#8220;Therefore, the rights of an individual may not be violated by the government, regardless of whether or not there is a physical intrusion into any given area.&#8221;</p>

Others feel that the world we live in can tend toward crudeness and a lack of sensitivity toward minorities, women, the elderly and the mentally challenged. The common response to that is to say that we actually live somewhere in the middle where the world isn&#8217;t really too crude or too stifled, but that&#8217;s not reallly a good analysis of what it&#8217;s actually like out there.</p>
<p>You see, most of the time the world is just fine. People of all genders, colors, creeds and races can get along with each other and sort of pull in the same direction with little to no problems. However, that ninety five percent of the time doesn&#8217;t make up for the five percent of the time when people &#8211; and again, it&#8217;s usually people who fall into the categories mentioned above &#8211; are harrassed, discriminated against, or otherwise treated as less than another group.</p>
<p>That is why, if you feel you have suffered something akin to what I&#8217;ve just described, you should do your due diligence and find a competent harassment attorney. Especially if it&#8217;s a work related situation.</p>
<p>And remember, harassment doesn&#8217;t have to be as overt as being called the &#8220;N-word&#8221; by an overbearing boss.
